Terms of Service
Last updated: 7 October 2026
1. About these terms
- These terms set out the rules for using the Foocha mobile app for iOS and Android (the “App” or “Platform”).
- The Platform is run by [TODO: nazwa firmy], [TODO: numer w rejestrze, np. Companies House / KRS], [TODO: adres siedziby] (the “Operator”, “we”, “us”). Contact: pomoc@example.com.
- These terms are available free of charge on this website in a form you can save and print.
- To use the App you need a smartphone with an up-to-date version of iOS or Android, an internet connection and an email address. To record videos, the App asks for access to your camera, microphone or photo library.
- By creating an account you accept these terms. How we handle personal data is explained in our Privacy Policy.
2. Definitions
- User: a person with an account in the App. The same person can both buy and sell.
- Seller: a User who posts a Listing.
- Buyer: a User who buys a Task from a Listing.
- Listing (a “foocha” in the App): an “I’ll do X for Y” offer: a video, a title, a description and a price.
- Task: the service the Seller promises to perform in a Listing.
- Order: a Buyer’s purchase of a Task, from payment until completion or refund.
- Proof video: a video in which the Seller shows that the Task was done. It is private unless the Seller allowed the Buyer to share it (section 13.4).
- Dispute: a problem with a Task reported by the Buyer and decided by the Operator.
- Stripe: the company that processes payments in the App and payouts to Sellers.
3. What the Platform is
- The Platform lets people offer and buy small services that the Seller performs in person in the real world, for example eating a lemon without flinching, singing at a party or helping with a move.
- The contract to perform a Task is between the Buyer and the Seller. The Operator is not a party to it: we don’t perform Tasks, we don’t employ Sellers and we don’t guarantee that the Buyer will be happy with a Task.
- The Operator:
- provides the App, including a chat for each Order,
- collects payment from the Buyer on the Seller’s behalf and holds it until the Order ends (section 8),
- refunds the Buyer in the cases described in section 9,
- decides Disputes (section 10).
- Buyers don’t pay the Operator for using the Platform. Sellers pay a fee on Tasks they sell (section 11).
4. Your account
- You can watch the feed and Listings without an account. To buy a Task, post a Listing or use the chat, you need an account. You must be at least 18 years old and have full legal capacity to create an account.
- You sign in with your email address and a one-time code we send to it. When you first sign in, you choose a username that other people see. It must not be misleading (for example, impersonating another person or the Operator) or offensive.
- Don’t share your account with anyone. You are responsible for what happens on your account.
- The contract for using the Platform starts when you create an account and lasts until it ends. You can end it at any time by deleting your account in the App (Profile → Delete account). Any Order in progress has to finish first. What happens to your data is explained on the Delete your account page.
5. Listings
- To post a Listing, a Seller sets up payouts with Stripe and chooses the country of their payout account: the United Kingdom, Poland or the United States. The country sets the currency of their Listings (pounds, złoty or dollars). It can’t be changed later.
- A Listing has a video (up to 60 seconds), a title, a description and a price. The minimum price is £5, PLN 20, $5, depending on the currency. The Seller chooses the type of Listing: in person (they do the Task with the Buyer, e.g. at the Buyer’s event; a Proof video is optional) or on video (they do the Task on their own and record it; they can’t report it as done without a Proof video). For an on-video Listing the Seller also decides whether the Buyer may share the Proof video (section 13.4). The Buyer sees the type and this decision before buying. An in-person Listing also has an approximate location (town) and a travel distance: 5, 10, 25 or 50 km. The Seller sets them when posting and can’t change them later.
- A Listing is for a service that the Seller performs in person in the real world. The video in a Listing presents the offer, and the Proof video is evidence that the Task was done. Digital content (videos, photos, files, access to content) can’t be sold as the subject of an Order.
- The Seller is responsible for the Listing and the Task: that they comply with the law and these terms, that the description is true, that they have the consent of anyone shown in the video, and for paying tax on their income.
- The Platform is currently intended for private individuals who occasionally offer small services outside of any business. If you want to sell as a business, contact us before posting a Listing. When you buy from a private individual, you don’t have the consumer rights you would have against a business (such as the right to cancel). Instead, you are protected by the Platform’s rules: an automatic refund if the Task isn’t done, and Disputes.
- A Listing can be bought many times. While an Order is in progress it isn’t available to others, and once the Order ends it returns to the feed. The Seller can archive and restore it in their Profile. A published Listing (video, title, description, price) can’t be edited in the App; post a new one instead.
- Listings are public: all Users can see them, and anyone with a link to the video can watch it.
6. What’s not allowed
- You must not offer, buy or show on the Platform:
- sexual services or sexual content (including escorting, “sugar dating”, nude photos and videos), and never anything that sexualises minors,
- drugs, controlled substances, or prescription medicines without a prescription,
- weapons, ammunition or explosives,
- violence, threats, intimidation, or harming people or animals,
- fraud: fake documents or reviews, taking exams for someone else, taking over accounts, renting out bank accounts, trading in personal data,
- theft, handling stolen goods, illegal gambling or any other crime,
- Tasks that put the health or life of the performer or anyone else at risk,
- harassment, hate speech or discrimination,
- content that infringes other people’s rights, such as copyright or image rights (filming someone without their consent),
- digital content as the subject of an Order (section 5.3).
- You must not go around the Platform: arrange payment outside the App for a Task you found in the App, or encourage this in the chat. Payments outside the App aren’t protected by sections 9 and 10.
- You must not disrupt the App, get around moderation or collect other Users’ data.
7. Moderation and listing order
- Before it is published, every Listing is checked automatically by an artificial intelligence model. It assesses the title, the description, a transcript of what can be heard in the video, and the picture, including any text shown in it. The possible outcomes are:
- the Listing goes into the feed,
- the Listing goes into the feed and is also reviewed by a person (when the content is ambiguous),
- the Listing is rejected (when it clearly offers or shows something listed in section 6.1). The App tells you straight away.
- The Operator may block a Listing, remove content, restrict features or block an account if it breaks the law or these terms, including after a report from someone else. A blocked Listing disappears from the feed and the Seller sees the status “Blocked by moderation” in their Profile.
- For any such decision you can ask for the reasons and for a review by a person by writing to pomoc@example.com. We reply within 14 days. You can also take the matter to court.
- You can report illegal content to pomoc@example.com following the guidance on the Support and contact page.
- The feed shows active Listings by these rules: in-person Listings only to a User within the Seller’s travel distance (based on the phone’s approximate location or a town the User types in), nearest first; on-video Listings from the country set on the phone first, then newest first. Every third position goes to an in-person Listing while there are any. Listings the User hasn’t seen yet come first, then those seen longest ago. No one can pay for a higher position.
- A User may send at most 10 Listings for checking in 24 hours, rejected ones included (Support and contact). The Operator may raise this limit for selected Sellers.
8. Buying and payment
- The Buyer buys a Task with the “Buy for …” button and pays in the Stripe payment sheet by card or another method shown there (methods depend on the currency, e.g. BLIK for prices in złoty). The Buyer pays in the Listing’s currency. If their card is in a different currency, their bank converts it on its own terms.
- The contract between the Buyer and the Seller is made when Stripe confirms the payment. If someone else paid for the same Listing a moment earlier, the money is returned to the Buyer automatically.
- The Seller appoints the Operator as their limited agent to collect payments from Buyers on their behalf. A payment made to the Operator counts as a payment made to the Seller.
- The money stays in the Operator’s Stripe account until the Order ends. It then goes to the Seller (minus the fee) or back to the Buyer.
- Card details are processed by Stripe. The Operator doesn’t see or store them.
9. Doing the Task and accepting it
- After payment, the Buyer and Seller can agree the details in the Order’s chat. For an in-person Listing they also agree on the place and time. Before buying, the Buyer checks that the place is within the Seller’s travel distance. If it isn’t and the Seller can’t get there, the Seller cancels the Order (section 9.3).
- The Seller has 7 days from payment to do the Task and report it in the App (“Mark as done”), with a Proof video and a message to the Buyer. The deadline is shown on the Order screen.
- Until they report the Task as done, the Seller can cancel the Order. The Buyer then gets a full refund.
- If the Seller doesn’t report the Task as done in time, the Buyer automatically gets a full refund and the Listing is archived.
- After the Seller reports the Task as done, the Buyer has 72 hours to:
- accept it (“Accept”): the money goes to the Seller and the Buyer can’t undo this in the App (except for a chargeback the bank decides in the Buyer’s favour, section 10.4), or
- report a problem (“Report a problem”) and describe what’s wrong: this opens a Dispute.
- If the Buyer does nothing within 72 hours, the Task is accepted automatically.
- Refunds go back to the Buyer’s card or other payment method. How long they take to appear depends on the bank, usually a few working days.
- When the Order ends, the Buyer can rate the Seller from 1 to 5 stars: once, without changing it later, within 14 days. An Order can be rated if the Seller reported the Task as done or the deadline for doing it passed, including after a Dispute. An Order the Seller cancelled can’t be rated. Only the Buyer who paid for the Order can rate it: this is how we check that a rating comes from someone who bought the service. Other Users see the Seller’s average rating and the number of ratings. A rating must honestly reflect how the Order went. Ratings must not be given, bought or promised in exchange for a benefit.
10. Disputes
- During a Dispute the money waits for the Operator’s decision. The Operator watches the Proof video (if there is one), reads the reason for the Dispute, the Seller’s message and the chat, and may ask both sides questions in the chat.
- The Operator decides whether to pay the Seller or refund the Buyer and gives reasons that both sides can see. Without a Proof video, the Operator decides on its own assessment of the information available.
- The decision ends the Dispute in the App. It doesn’t take away either side’s right to bring a claim against the other in court.
- Before you ask your bank to reverse a card payment (a chargeback), please use a Dispute. If a chargeback reaches Stripe, we will give Stripe the Order details, including the Proof video and the chat. Until the chargeback is decided, the Order’s money and the Seller’s payouts to their bank account are on hold. If the bank decides in the Buyer’s favour, the Order ends as refunded and the Operator takes back the amount transferred for that Order from the Seller’s Stripe balance, also after acceptance. The balance can then go below zero: the Seller’s next earnings cover the difference, and the Operator may also ask the Seller to repay it.
11. Fees and payouts
- The Buyer pays the price in the Listing. The Operator doesn’t add any fees. The Buyer’s bank may charge for currency conversion.
- The Seller pays the Operator a fee of 10% of the price of every completed Order. The fee is deducted from the payout. Posting a Listing is free, and there is no fee on refunded Orders.
- When an Order is completed, the amount after the fee goes to the balance of the Seller’s Stripe account, in the currency in which the Operator received the payment. We pay out the whole balance to the Seller’s bank account once it reaches £50, PLN 200, $50 (depending on the currency), and at least every 80 days. If Stripe pauses payouts on the Seller’s account (for example because it needs more information), the money waits until payouts are active again.
- Payment processing services for Sellers on Foocha are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to these terms or continuing to operate as a Seller on Foocha, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of Foocha enabling payment processing services through Stripe, you agree to provide Foocha accurate and complete information about you and your business, and you authorise Foocha to share it and transaction information related to your use of the payment processing services provided by Stripe.
- Sellers are responsible for their own tax. The Operator may be required by law to collect information about Sellers and their income from the Platform and report it to tax authorities (for example under digital platform reporting rules).
12. Safety and conduct
- Respect other Users. Use the chat for matters related to the Order.
- You do and order Tasks at your own risk. Take ordinary care when meeting people in person. The Operator doesn’t verify Buyers’ identity, and Sellers’ identity is verified by Stripe only for payouts.
- Don’t share card details, passwords or sign-in codes in the chat. The Operator will never ask for them.
13. Your content
- You keep the rights to the videos and text you add.
- You give the Operator a free, non-exclusive, worldwide licence to store, copy, compress and convert, automatically analyse (moderation) and display that content in the App and on Listing pages on our website (Listing links), to the extent needed to run the Platform. The licence lasts for as long as we keep the content under our Privacy Policy.
- Proof videos, messages sent with them and the chat are visible only to the parties to the Order and the Operator, except as set out in point 4. The Operator uses them to handle the Order, Disputes and payment chargebacks, and where the law requires it.
- If the Seller allowed sharing in an on-video Listing, the Seller grants the Buyer a free, non-exclusive and perpetual licence to publish the Proof video on social media and in messaging apps, in full and with the Foocha watermark that the App adds when sharing. The Buyer may use it once the Order ends with the Seller being paid (acceptance, including automatic acceptance, or the Operator’s decision in a Dispute). The licence doesn’t cover removing the watermark, editing the video or using it in advertising. Without this permission the Proof video is for the Buyer’s private use only.
- Anyone may share a link to a Listing and the Listing video with the Foocha banner (price and Listing address) that the App adds when sharing. By posting a Listing, the Seller grants the Operator and Users a free, non-exclusive, worldwide licence to publish the Listing video with that banner on social media and in messaging apps to promote the Listing. The licence doesn’t cover removing the banner, editing the video or using it for any other purpose. Once a Listing is removed, its link stops working, but we can’t remove earlier posts on other services.
- You are responsible for having the right to add the content, including the consent of anyone who can be seen or heard in it.
14. Liability
- We work to keep the App running, but there may be interruptions, for example during maintenance or outages at our providers.
- The Operator isn’t responsible for performing Tasks, their quality, or what the parties do outside the App. The Seller is responsible for the Task.
- Nothing in these terms excludes or limits liability where the law doesn’t allow it, in particular for intentional harm, for death or personal injury caused by our negligence, or any rights consumers have by law.
15. Complaints about the Platform
- Send complaints about how the App works or about the Operator’s services to pomoc@example.com. Describe the issue and give your account’s email address.
- We reply within 14 days to the address the complaint came from.
- Report a problem with a specific Order in the App first (“Report a problem”, section 10).
16. Suspension and termination
- The Operator may suspend an account or end the contract if a User seriously or repeatedly breaks these terms or the law. For serious breaches, such as fraud or content listed in section 6.1, we may do this immediately. In other cases we give 30 days’ notice.
- The Operator may close the Platform with at least 30 days’ notice to Users.
- Orders in progress are settled under these terms even after an account is suspended.
- We tell you the reason for our decision. You can appeal it by writing to pomoc@example.com.
17. Changes to these terms
- We may change these terms for good reasons, such as changes in the law, new features in the App or a change of payment provider.
- We will tell you about a change in the App or by email at least 15 days before it takes effect. If you don’t agree, you can delete your account during that time.
- Changes don’t apply to Orders paid for before they take effect.
18. Law and disputes
- These terms are governed by [TODO: governing law, e.g. the laws of England and Wales or Polish law]. If you are a consumer, you keep the protection given to you by the mandatory laws of the country where you live, and you can bring a claim against us in the courts of that country.
- If you are a consumer, you may also be able to use out-of-court dispute resolution available in your country.
- These terms are available in English and Polish.
19. Contact
For anything, including as the point of contact for public authorities, write to us in English or Polish: pomoc@example.com.
